Terms of service
These terms are an agreement between you and Ecropolis LLC ("we", "us") for your use of the JWalk Go mobile app, the web pages at app.jwalkgo.com, this website, and the tours and other content in them (together, "JWalk Go"). By downloading, accessing or using JWalk Go, you agree to these terms and to our privacy policy. If you do not agree, do not use JWalk Go.
Please read sections 3, 4, 5, 13, 14 and 16 carefully. They say that JWalk Go is for entertainment and general information only, that you are responsible for your own safety while you use it, that our liability to you is limited, and that disputes are resolved by individual binding arbitration rather than in court or as a class action, unless you opt out.
1. Who can use JWalk Go
You must be at least 13 years old to create an account. If you are under 18, you may use JWalk Go only with the involvement of a parent or guardian, who agrees to these terms for you. Children taking a tour must be supervised by an adult at all times.
2. What JWalk Go is
JWalk Go plays self-guided tours: audio, text, images, maps and directions tied to places ("stops"). When your phone's location shows you have arrived at a stop, the app offers it to you; on some tours it may start the stop for you. Tours are written by us and by guides we work with.
3. For entertainment and general information only
Tours are storytelling. They are offered for entertainment and general interest, and they are not professional, historical, legal, religious, safety, medical or navigational advice.
- We do not certify that anything in a tour is true, complete or current. History is often disputed and incompletely recorded. Tours may include legend, folklore, oral tradition, opinion, interpretation and dramatization, and they may contain errors.
- Opinions in a tour belong to its writer or narrator and are not necessarily ours.
- Opening hours, access, prices, routes, directions, street conditions and the businesses mentioned in tours change without notice. Check anything that matters to you, such as whether a building is open, before you rely on it.
- Maps, distances, walking times and accessibility details (steps, surfaces, shade, restrooms) are approximate.
- Location technology is imperfect. A stop may be offered or start early, late, or not at all, and the map may show you in the wrong place.
If you spot a mistake, please tell us. We correct tours, but we are not obliged to, and a correction does not mean the rest of a tour is accurate.
4. Your safety: use your phone responsibly
You are responsible for your own safety and for the safety of anyone with you, including children. JWalk Go is designed to stay in your pocket. When you use it:
- Watch where you are going, not your screen. Stop walking, in a safe place out of the way of others, before you look at or handle your phone.
- Obey traffic laws and signals. Cross only at crossings, look both ways, and never step into the road because a map or a story suggests a direction.
- Keep the volume low enough to hear traffic, cyclists, horns, sirens and the people around you. Consider using one earbud or none.
- Never use JWalk Go while driving or riding. On a driving or cycling tour, set the tour up before you move, let it run hands-free, and leave any interaction to a passenger. Never let the app distract the driver, and follow all laws on phone use in vehicles.
- Stay on public ground. Directions are not permission to enter. Do not enter private property, closed sites, construction areas, rooftops, waterfronts or anywhere unsafe or restricted, whatever a tour says.
- Respect the places you visit. Many stops are working churches, synagogues, cemeteries, homes and businesses. Follow their rules and posted hours, keep quiet during services, and do not disturb residents.
- Know your limits. Tours involve walking, sometimes long distances, on uneven pavement, steps, cobblestones and slopes, in heat, cold, sun and rain. Wear suitable shoes, carry water, take breaks, and check with a doctor if you have any concern about your fitness.
- Be alert to your surroundings and belongings, especially after dark, in crowds and in unfamiliar areas. Keep your phone charged and know how to get help.
- Plan your trip back. Tours may end far from where they began. Information about getting back is a convenience, not a guarantee that a service is running.
5. Assumption of risk
Walking, driving and cycling in public places carry inherent risks, including traffic, falls, weather, crime, and the condition of streets, sidewalks and buildings. We do not control any of the places a tour visits or how you get between them. You take a tour voluntarily and at your own risk, and you accept those risks for yourself and for anyone, including any child, who takes a tour with you.
6. Places and businesses on tours
Tours visit and mention places and businesses we do not own or control, and their appearance in a tour is not an endorsement. Some side stops may be businesses that we, a tour's creator or a partner own or are paid by; where that is the case, the tour says so. Your dealings with any place or business are between you and them, under their own terms.
7. Your account
Keep your sign-in methods secure and tell us at once if you think someone else has used your account. You are responsible for what happens under your account. You can delete your account at any time from the app; see our privacy policy.
8. Purchases, previews, codes and refunds
- Purchases in the app are made through Apple's App Store or Google Play and are subject to their terms. Refund requests for those purchases go to Apple or Google under their policies; we cannot issue them.
- Purchases on the web, if we offer them, are subject to the price, refund terms and any other terms shown at checkout.
- Previews are free samples and may change or be withdrawn.
- Tour codes are issued by us or our partners. Each code can be redeemed once, onto one account. Codes have no cash value, cannot be resold or exchanged for money, and may expire or stop working if a partner's arrangement ends before you redeem them. A code that has been redeemed is a license to that tour on the same terms as a purchase.
- What you are buying is a personal license to use a tour in JWalk Go, not ownership of it. We update tours, which may change their content, stops or route. We aim to keep tours you have bought available for as long as JWalk Go operates, but a tour may be withdrawn, for example if a creator's rights end or a route becomes unsafe.
- Prices and what is included may change, but a change does not affect a tour you already have.
9. How you may use tours
We give you a limited, personal, non-exclusive, non-transferable, revocable license to use JWalk Go and the tours you have access to for your own non-commercial use. You may not:
- copy, record, rebroadcast, publish, sell or share tour content, or play it to paying groups or as part of a commercial tour;
- copy, scrape or extract tours, maps or other content, or use them to train or build any other product, including artificial intelligence models;
- reverse engineer, decompile or tamper with the app or bypass any access controls;
- guess, generate, share publicly or misuse tour codes;
- use JWalk Go to break the law, harass anyone, or interfere with the service or other users.
10. What you send us
If you send us a correction, story, note, photo or other material ("submissions"), you keep ownership of it, and you give us a worldwide, royalty-free, perpetual, irrevocable license to use, edit, adapt, publish and distribute it in JWalk Go and in promoting it, crediting you as you choose. You confirm that you have the right to give us that license, that your submission is accurate to the best of your knowledge, and that it does not include anyone's private information, or a photo of a person who has not agreed, especially a child. We do not have to use any submission, and we may remove any submission.
11. Our content and names
JWalk Go, its tours, audio, text, images, maps and software are owned by us, our tour creators or our licensors and are protected by copyright and other laws. Map data may include OpenStreetMap data, © OpenStreetMap contributors, available under the Open Database License. "JWalk Go" and our logos are our trademarks. Nothing in these terms gives you a right to use them.
12. Ending your use
You may stop using JWalk Go and delete your account at any time. We may suspend or end your access if you break these terms or misuse the service, and we may change or stop offering any part of JWalk Go. Sections 3 to 6, 10, 11 and 13 to 19 continue to apply after your use ends.
13. Disclaimer of warranties
To the fullest extent permitted by law, JWalk Go and all tours and other content are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that JWalk Go will be uninterrupted, error-free or secure, that location features will work, or that any place, route or direction is safe, open or accessible.
14. Limitation of liability
To the fullest extent permitted by law, Ecropolis LLC, its owners, employees, contractors, tour creators, guides, narrators and partners will not be liable for any personal injury, death, property damage or loss, or any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or enjoyment, arising out of or relating to your use of JWalk Go, any tour, any place or business a tour visits or mentions, or your travel to, from or between stops, whether based on contract, tort (including negligence), product liability or any other theory, even if we have been told such damages are possible.
Our total liability for all claims relating to JWalk Go is limited to the greater of the amount you paid us for JWalk Go in the twelve months before the claim arose and fifty US dollars (US$50).
Some places do not allow certain warranties to be excluded or liability to be limited, so some of sections 13 and 14 may not apply to you. Where that is so, our liability is limited to the smallest amount the law allows. Nothing in these terms limits liability that cannot be limited by law.
15. Indemnity
You agree to defend, indemnify and hold harmless Ecropolis LLC and the people listed in section 14 from any claims, losses and expenses (including reasonable attorneys' fees) arising from your use of JWalk Go, your submissions, your breach of these terms, or your violation of any law or the rights of anyone else, including by entering property you were not permitted to enter.
16. Disputes: informal resolution, then individual arbitration
Talk to us first. Before filing any claim, email us at [email protected] with a description of the problem and what you want. We will try in good faith to resolve it within 60 days.
Arbitration. If we cannot resolve it, you and we agree that any dispute relating to JWalk Go or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. Either of us may instead bring an individual claim in small claims court, and either of us may ask a court to stop infringement or misuse of intellectual property. The arbitration may be conducted by video or on written submissions, and an in-person hearing will be held in the county where you live, if you prefer. The arbitrator may award the same individual relief a court could.
You and we each give up the right to a jury trial and to take part in a class action, class arbitration or representative proceeding. Claims may be brought only individually.
Opting out. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these terms, with your name, your account email address and a clear statement that you are opting out. Opting out does not affect any other part of these terms.
If the class action waiver is found unenforceable for a claim, that claim will be decided in court and not in arbitration. Any claim must be brought within one year of when it arose, where the law allows that limit.
17. Governing law
These terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. Any claim not subject to arbitration will be brought in the state or federal courts in Dallas County, Texas, and you and we consent to their jurisdiction. If you are a consumer living outside the United States, you keep any protections the law where you live gives you that cannot be waived.
18. App stores
If you downloaded JWalk Go from Apple's App Store, you and we agree that these terms are between you and us, not Apple, and that we, not Apple, are responsible for the app and its content, maintenance, support, warranties and any claims about it (including product liability, legal compliance and intellectual property claims). Apple has no obligation to provide maintenance or support. If the app fails to meet any applicable warranty, you may tell Apple, and Apple may refund the purchase price of the app, if any; to the fullest extent permitted by law, Apple has no other warranty obligation. You confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use must also follow the App Store's usage rules. If you downloaded JWalk Go from Google Play, Google's terms for Google Play also apply.
19. General
These terms and the privacy policy are the whole agreement between you and us about JWalk Go. If any part is found unenforceable, the rest stays in effect. Our not enforcing a part of these terms is not a waiver. You may not transfer these terms; we may transfer them in a merger, acquisition or sale of assets. We may change these terms by posting a new version here with a new effective date, and if a change is significant we will tell you in the app or by email before it takes effect. Continuing to use JWalk Go after a change means you accept it.
